REPRESENTATIVE MATTERS

• Defended a bank in a $50 million fraud case brought by 14 Oregon counties. After dismissal of most of the claims, and an award of sanctions against the counties for discovery violations, the counties voluntarily dismissed their case with prejudice.

• Obtained judgment for over $3 million against loan servicers who stole funds from lenders while servicing lenders’ construction loans to third parties.

• Obtained judgments for lenders and loan servicers in numerous commercial and residential debt collection and foreclosure actions, including numerous actions against lenders and loan servicers by borrowers and guarantors alleging lender liability claims, wrongful foreclosure claims, and claims for violation of the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Real Estate Settlement Procedures Act, and other federal and state consumer protection statutes.

• Successfully represented lenders in numerous disputes involving construction liens, resolving many out of court but also prevailing against lien claimants in court at trial and on appeal.

• Guided lenders and loan servicers through many bankruptcies filed by borrowers and guarantors, resulting in successful recoveries on secured and unsecured claims.

• On behalf of unsecured creditor, filed objection to bankruptcy plan that sought to discharge non-debtor guarantor’s liability; objection resulted in settlement paying 90% of creditor’s claim.
