Nick Beyer’s practice focuses on complex commercial litigation, including tort and contract disputes, real estate disputes, and insurance coverage matters. Nick has substantial experience litigating in trial and appellate courts in Oregon and Washington, having achieved strategic victories in matters ranging from contract enforcement and business torts to real property disputes and indemnity litigation. Nick has been recognized for his ability to develop novel legal arguments that transform cases in which his clients face significant risk into victories.

Nick enjoys engaging with the law creatively and resourcefully to further his clients’ goals and is particularly proud of the relationships he builds with clients through the course of litigation. Nick seeks to understand his clients’ perspectives and experience to achieve solutions suiting their specific needs.

Representative Cases

Complex Litigation

  • Briefed, argued, and ultimately prevailed in case on review before the Oregon Supreme Court regarding the enforceability of an agreement to arbitrate disputes arising from independent contractor agreements, avoiding a potential multi-million-dollar class action proceeding and resolving nearly a decade of litigation.

  • Obtained summary judgment on claims of intentional and negligent infliction of emotional distress against drug and alcohol rehabilitation clinic on novel legal grounds, resulting in the dismissal of case.

Real Estate Litigation

  • Favorably resolved property boundary dispute with neighboring property owners, preserving client’s interest in irrigation rights to water on adversely possessed property.

  • Prevailed in arbitration proceeding filed by homeowner against HOA on claims of negligence, UTPA violations, and slander of title, and secured an award of attorney fees. Then, successfully defended similar claims by the same homeowner against the property management company responsible for the planned community, obtaining a second successful arbitration verdict

  • Obtained summary judgment dismissal of seven claims, including breach of HOA bylaws and CC&Rs and breach of fiduciary duty, asserted by homeowner against HOA and its board of directors, and secured an award of attorney fees.

Outside of the office, Nick enjoys spending time outside in his garden growing fruit nobody has heard of, cycling, climbing, hiking, and foraging for wild foods, often in tow of his partner Sarah and dog Shelby.
