INSURANCE COVERAGE DISPUTES

Barg Singer Hoesly regularly represents property owners and other clients in disputes with their insurers over whether insurance will cover a claim that the client has filed against their insurer (including their title insurance company), a claim that a third-party has filed against the client, or a claim that a client has against a third-party’s insurer. We work hard in these matters to get coverage for our clients so that the insurer will pay the benefits policyholders fronted premiums for. We also occasionally represent insurers in claims brought by their insureds. In all matters, we pay close attention to the terms in the insurance policy as well as the facts of the case and governing law.


REPRESENTATIVE MATTERS

  • Obtained summary judgment on behalf of property owner establishing insurance coverage under a class of historic comprehensive general liability insurance policies with respect to the environmental cleanup of the real property. 

  • Represented property owner in recovering 100 percent of the cost to restore damage to property and improvements caused by a third-party logistics company from the third-party’s insurance company, which had offered a settlement of under 20 percent of the restoration costs.

  • Represented policyholders in seeking coverage from title insurance companies.

  • Obtained insurance coverage for defense of client in action for conversion of deceased’s remains.

  • Represented insurance broker at trial on claims of breach of contract and negligence seeking $3 million for failing to procure appropriate insurance, as well as third-party claim for indemnification against wholesale broker. The case settled on favorable terms.
